Estate Planning
Estate planning enables you to determine how your assets will be distributed during your lifetime and after your death, how to provide support and maintenance for your surviving spouse and loved ones, and who will assist with your future financial and health care needs in the event you are unable to do so.

Daubert Law Firm, LLC provides estate planning for simple and complex situations. We review your family and business situations and help develop an estate plan based on your assets, needs and objectives.

Estate Planning Services

  • Coordinated asset disposition planning – review assets, liabilities, beneficiary designations, Pay on Death (POD) and Transfer on Death (TOD) designations in relation to your objectives
  • Wills – basic and Trust Wills to provide for estate distribution, estate tax planning, naming personal representatives and trustees and guardians for minor children
  • Revocable Living Trusts – to provide for distribution of your estate outside of probate court, as well as  coordinated estate management if you become incapacitated; this includes transfers of assets to fund the Trust
  • General Durable Powers of Attorney – to appoint someone to handle your affairs if you are unable to do so yourself
  • Health Care Powers of Attorney – to appoint someone to make your health care decisions for you if you are unable to do so yourself
  • Declarations to Physicians (Living Wills) – specifying your preferences on life prolonging procedures if you ever develop a terminal condition or persistent vegetative state

  • Marital Property Agreements – Prenuptial and Postnuptial Agreements governing ownership of assets between spouses and rights to assets at death or in the event of divorce
  • Estate Tax Planning – minimize or avoid estate taxes through creative use of transfers to family, trusts, and other entities
  • Gifting Plans – maximize your personal and family goals with effective gifts to family and charities
  • Irrevocable Trusts – to reduce estate taxes and for other purposes
  • Life Insurance Trusts – to reduce estate taxes and for other purposes
  • Medical Assistance Eligibility Advice – to prepare to qualify for the program that pays for long term nursing home care
